Please read these Terms & Conditions (“Terms”) carefully before accessing or using the website or services operated by PARIS FORINO DESIGN, INC. also doing business as PARIS FORINO, (“PARIS FORINO,” “we,” “us,” or “our”).

By accessing or using our website, platform, or any related content, (collectively, “the Platform”) you agree to these Terms. If you do not agree, do not use the Platform.

1. Eligibility

The Platform is intended for a general audience and may be accessed by individuals of any age. However, it is not directed to children under the age of 13, and PARIS FORINO does not knowingly collect personal information from children under 13 without verifiable parental consent, as required under COPPA (Children’s Online Privacy Protection Act.).

If you are under 18, you may access and use the Platform only with permission and supervision from a parent or legal guardian. By accessing the Platform, you represent and warrant that you are at least 13 years old and, if under 18, accessing it with parental or guardian permission.

2. Ownership of Materials

All content on the Platform, including but not limited to designs, photographs, project images, logos, renderings, artwork, graphics, text, software, layouts, and the overall look and feel (collectively, “the Materials”), is owned by or licensed to PARIS FORINO and is protected by copyright, trademark, and other intellectual property laws.

No rights are granted except as expressly provided herein.

3. Limited License to Use the Platform

Subject to your compliance with these Terms, PARIS FORINO grants you a limited, non-exclusive, non-transferable, revocable license to:

  • access and use the Platform for personal, non-commercial purposes

  • view the Materials solely for browsing and informational purposes

You may not:

  • copy, modify, reproduce, distribute, transmit, publish, republish, or create derivative works from the Materials

  • reverse engineer or attempt to extract source code

  • exploit any Materials for commercial use

Any use beyond this license is prohibited without our prior written consent.

4. User Submissions

4.1 Submissions

The Platform may allow you to submit inquiries, messages, files, project information, photos, drawings, or other materials (“Submissions”).

4.2 Treatment of Submissions

Unless expressly stated otherwise in our Privacy Policy, we treat Submissions as private communications between you and PARIS FORINO. We do not publicly disclose Submissions.

4.3 Rights You Grant to PARIS FORINO

By voluntarily sending us any Submission, you grant PARIS FORINO a limited, non-exclusive, worldwide license to use that Submission solely for:

  • reviewing and responding to your inquiry

  • evaluating your project

  • preparing proposals or service recommendations

  • communicating with you

  • internal business operations related to providing our services to you

We will not use your Submissions for marketing, publication, or any external purpose without your express written permission.

We will handle any personal information contained in your Submissions in accordance with our Privacy Policy.

4.4 Your Responsibilities

You represent and warrant that:

  • you own or have permission to provide the Submission

  • the Submission does not violate the rights of any third party

  • the Submission complies with these Terms

You are responsible for any costs or damages resulting from your breach of this section.

5. Feedback

Any suggestions, ideas, or proposals (collectively, “Feedback”) you provide to PARIS FORINO regarding improvements, features, or functionality shall be considered non-confidential.

You hereby assign to PARIS FORINO all right, title, and interest in such Feedback. Where assignment is not legally permitted, you grant us an exclusive, perpetual, royalty-free license to use it for any purpose.

You acknowledge that:

  • we are not obligated to use your Feedback

  • you are not entitled to compensation

  • we may use similar ideas previously known or developed independently

6. Prohibited Activities

You agree not to:

  1. Use robots, spiders, scrapers, crawlers, or automated systems to access the Platform

  2. Interfere with or disrupt Platform operations or servers

  3. Attempt to gain unauthorized access to any systems

  4. Upload viruses, harmful code, or corrupted data

  5. Engage in fraudulent, unlawful, harassing, or abusive conduct

  6. Post false, deceptive, or misleading content

  7. Post anything unrelated to our business or services

  8. Use the Platform for commercial solicitation without permission

  9. Impersonate any person or entity

  10. Violate any applicable law or regulation

Violations may result in access termination.

7. Third-Party Links

The Platform may include links to third-party websites or services. PARIS FORINO does not control or endorse third-party content and is not responsible for any damages or losses arising from their use.

8. No Professional Advice

All information on the Platform is provided for general informational purposes only. It does not constitute design, architectural, engineering, construction, legal, financial, or professional advice.

9. Project Photography Rights

Unless otherwise agreed in writing:

  • PARIS FORINO retains full rights to photograph completed projects

  • We may use project images for portfolios, publications, press, marketing, and promotional purposes

  • Clients may not commercially use or modify such photography without our permission

10. Disclaimers

To the fullest extent permitted by law, the Platform and Materials are provided “as is” and “as available” without warranties of any kind, whether express or implied.

We do not guarantee:

  • uninterrupted operation

  • error-free content

  • accuracy, completeness, or reliability of Materials

  • that the Platform is free of viruses or harmful components

Your use is at your own risk.

11. Limitation of Liability

To the maximum extent permitted by law, PARIS FORINO and its officers, employees, agents, affiliates, and partners (“PARIS FORINO PARTIES”) are not liable for any:

  • indirect, incidental, special, punitive, or consequential damages

  • loss of profits, revenue, data, or goodwill

  • damages resulting from your use or inability to use the Platform

Some jurisdictions do not allow exclusions; in such cases, the limitations apply to the fullest extent permitted by law.

11.1 Release and Waiver of Liability

To the fullest extent permitted by law, you agree that your use of the website and its content is at your sole risk. You hereby release, waive, and discharge PARIS FORINO, its owners, employees, contractors, and affiliates from any and all claims, liabilities, damages, losses, or causes of action arising out of or related to your use of, or reliance on, the website or its content.

12. Indemnification

You agree to indemnify and hold harmless the PARIS FORINO PARTIES from any claims, damages, liabilities, costs, or expenses arising from:

  • your use of the Platform

  • your Submissions

  • your violation of these Terms

  • your violation of third-party rights

13. Termination

PARIS FORINO may, at its sole discretion and without notice:

  • suspend, restrict, or terminate your access

  • remove or disable any Submissions

  • refuse future access to the Platform

PARIS FORINO has no obligation to disclose the reason for termination.

15. Arbitration; Class Action Waiver

15.1 Mandatory Arbitration

Any dispute arising out of or relating to these Terms or the Platform shall be resolved exclusively through binding arbitration, administered by AAA or JAMS.

15.2 No Jury Trial

You waive the right to a court or jury trial.

15.3 No Class Actions

Disputes may only be brought individually. You waive the right to participate in class or representative actions.

15.4 Opt-Out

You may opt out within 30 days of first using the Platform by emailing:

16. Governing Law

These Terms shall be governed by the laws of the State of New York, without regard to conflict-of-law rules.

17. International Users

If you access the Platform from outside the U.S., you do so at your own risk. You are responsible for complying with all local laws.

If you are located in the EEA (European Economic Area), UK, or Switzerland, our processing of personal data is governed by our Privacy Policy in accordance with GDPR.

18. Accessibility

PARIS FORINO strives to comply with WCAG 2.1 AA accessibility standards.

19. Force Majeure

We are not liable for delays or failures caused by events beyond our reasonable control, including natural disasters, war, terrorism, labor disputes, supply chain disruptions, utility failures, or acts of government.

20. Assignment

You may not assign any rights or obligations under these Terms.
PARIS FORINO may assign these Terms without notice.

21. Entire Agreement

These Terms constitute the entire agreement between you and PARIS FORINO and supersede all prior agreements.

22. Severability

If any provision is found invalid, the remaining provisions shall remain in full force.

23. Waiver

Failure to enforce any right or provision shall not constitute a waiver of such right.

24. Changes to These Terms

We may update these Terms at any time. The revised Terms will be posted with an updated “Last Updated” date. Continued use constitutes acceptance.
